Mohammad Habibi, Teachers’ Activist, was Sentenced to Ten Years Imprisonment and Lashings

Amir Reissian, lawyer of Mohammad Habibi, the teacher activist, reported that his client received a sentence of 10 years imprisonment and 74 lashes sentence, as well as a 2-year ban from participating in activities for parties and political and social groups, and ban on leaving the country as a supplementary punishment

He stated that according to article 134 of the Penal Code, all punishments of Mohammad Habibi were increased by one and half  and the highest punishment would be applicable, he said, ” Mohammad Habibi was charged with gathering and collusion for committing an offense against the security of the country to seven and a half years imprisonment , Propaganda against the system to 18 months imprisonment, disruption of the order to18 months in prison and 74 lashes, as well as a 2-year ban on activities in parties, political and social groups and the ban on leaving the country as a supplementary penalty. “

Mohammed Habib’s defense lawyer said this sentence is from first review court that we were informed today, and said, “We will appeal this sentence within 20 days.”

The hearing on Mohammad Habibi’s case was held on Monday, July 23rd, 2018, at the Revolutionary Court, Branch 26.

According to this report, article 134 of the Islamic Penal Code of 2013 stipulates: “In offenses punishable, if the offenses are not more than three, the court shall order the maximum penalty for each of these offenses and, if the offense are more than three crimes, The penalty shall be set for each of the to more than e maximum punishment with condition of  each penalty should  not exceed the one and half of punishment. In each of the above cases, only the highest punishment will be enforceable, and if that punishment is reduced or dismissed, the next highest punishment will be enforced. “

Earlier, Hossein Taj, another Mohammad Habibi’s attorney, had reported on repeated family effort of this imprisoned teacher and said, “The Habibi family regularly has contacted offices in various departments such as the Minister of Justice, the Deputy Minister of Education, the 90th Commissions, The judiciary, the Human Rights Directorate of the Judiciary, and the deputy prosecutor of Tehran, and their demand was, first of all, to address the physical condition of Mohammed Habibi, who was in not good situation, and secondly, his transfer to Evin Prison “.

Mohammad Habibi, 39, and a member of the board of directors of the Tehran Teachers’ Trade Union, on March 3rd, 2018, was arrested by the Revolutionary Guards, on charges of acting against the security forces, and after a month and half interrogation without access to a lawyer, on April 15th, 2018, was released on 250 million Toman bail.
